  • Stewart Rhodes, founder of the Oath Keepers, was sentenced to 18 years in prison for “seditious conspiracy” in connection with Jan. 6 Capitol attack by U.S. District Judge Amit Mehta despite not entering the Capitol or committing an act of violence.
  • The sentence is one of the longest imposed on a Jan. 6 defendant and serves as a warning to conservatives and Republicans concerning political protest, as prosecutors argued that Mr. Rhodes must serve a significant jail time to discourage future action.
  • Charges were based on Civil War era law which defines seditious conspiracy as two or more people plotting “to overthrow, put down, or to destroy by force the Government of the United States or to levy war against them” through force or prevented execution of any federal law.
  • Other examples of this include Aaron Burr’s trial for attempting leaving some states to leave the Union and seize land from Spain and Mexico; Christiana resistance in 1851 whereby escaped slaves resisted U.S. Marshalls seeking to capture them; Nelson Mandela’s detainment from 1962-90 for anti-apartheid activism; and Gandhi’s imprisonments between 1908-44 for leading Indian independence movement.

What is a Political Prisoner

A political prisoner is someone imprisoned for their political activity or beliefs that are contrary to those of their government. Political offense are not always the official reason for the prisoner’s detention.

Going back to The Revolutionary War Political prisoners were those captured by the British for their involvement or support of the war. They were often treated harshly and suffered from starvation, disease, and abuse.

Some of the political prisoners during the Revolutionary War were:

– **Robert Brown** (imprisoned 1777–1781), a U.S. Congressman from Pennsylvania who was captured at the Battle of Brandywine and held in New York City.

– **Andrew Jackson** (imprisoned 1781), a future U.S. President who was captured by the British as a teenager while serving as a courier for the militia in South Carolina. He was wounded and mistreated by his captors.

– **Charles Lee** (imprisoned 1776–1778), a major general in the Continental Army who was captured by the British at the Battle of Monmouth and held in New York City. He was later exchanged for a British general.

– **George Mathews** (imprisoned 1777–1778), a brigadier general in the Continental Army who was captured by the British at the Battle of Germantown and held in Philadelphia. He was later exchanged for a British colonel.

– **John Sullivan** (imprisoned 1776), a major general in the Continental Army who was captured by the British at the Battle of Long Island and held in New York City. He was later released on parole and exchanged for a British general.

– **William Alexander, Lord Stirling** (imprisoned 1776–1777), a brigadier general in the Continental Army who was captured by the British at the Battle of Long Island and held in New York City. He was later exchanged for a British general.


Some of the prison ships used by the British in the Revolutionary War were:

– **The Jersey**, the most infamous prison ship that moored in Wallabout Bay from 1780 to 1783. It was a 60-gun ship of the line that had been damaged and decommissioned. It held up to 1,000 prisoners at a time and was known as \”Hell\” or \”the floating dungeon\”. It was the scene of starvation, disease, cruelty, and death. More than 8,000 prisoners died on board and were buried in shallow graves on the shore or thrown overboard.

– **The Good Hope**, another prison ship that anchored in Wallabout Bay from 1776 to 1783. It was a former merchant vessel that had been captured by the British. It held about 200 prisoners and was notorious for its harsh discipline and torture.

– **The Scorpion**, a prison ship that operated in Charleston Harbor from 1780 to 1781. It was a former French frigate that had been captured by the British. It held about 250 prisoners and was overcrowded and filthy. Many prisoners died of smallpox and other diseases.

– **The Falmouth**, a prison ship that sailed to St. Lucia in the West Indies in 1778. It was a former British warship that had been damaged and converted into a prison ship. It held about 500 prisoners, mostly from New England, who were captured at sea or on land. Many prisoners died of tropical diseases and malnutrition.

There are also many recent political prisoners from different countries and historical periods

– **Nelson Mandela** (imprisoned 1962–1990), a South African anti-apartheid activist and leader of the African National Congress, who later became the first democratically elected president of South Africa.

– **Mahatma Gandhi** (imprisoned several times between 1908 and 1944), a leader of the Indian independence movement and advocate of nonviolent resistance against British colonial rule.

– **Leonard Peltier** (imprisoned since 1977), a Native American activist and member of the American Indian Movement, who was convicted of killing two FBI agents during a shootout at the Pine Ridge Reservation in 1975. His case has been controversial and he has been denied parole several times.

– **Stewart Rhodes** (sentenced to 18 years for seditious conspiracy) The federal law under which seditious conspiracy is charged defines it as two or more people plotting “to overthrow, put down, or to destroy by force the Government of the United States or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States … The maximum penalty for seditious conspiracy in the U.S. is 20 years in prison.


Some other prime examples of seditious conspiracy in history are:

– The **trial of Aaron Burr** in 1807 for allegedly plotting to urge some states to leave the Union and seize land from Spain and Mexico. He was acquitted after the jury was instructed that prosecutors had to show he actually went to war against the United States.

– The **Christiana resistance** in 1851, where escaped slaves and white people who aided them resisted U.S. marshals seeking to capture them. They were charged with treason but acquitted or had charges dropped after lawyers argued the resistance was not akin to “levying war”.
